Fisheries - what is devolved?

Senedd Cymru generally has legislative competence to pass laws relating to fisheries and fishing (pursuant to section 108 of, and paragraph 1 of Schedule 7 to, the Government of Wales Act 2006).

However, it cannot legislate in relation to the following reserved areas, as set out in Schedule 7A to, the Government of Wales Act 2006:

  • procedures on live animals for scientific or educational purposes;
  • veterinary medicinal products, including manufacture, authorisations for use and regulation of prices;
  • prohibition and regulation of imports and exports, except for—
    • the prohibition and regulation of movement into and out of Wales of food, plants, animals and related things for the purposes of—
      e) protecting human, animal or plant health, animal welfare or the environment, or
      f) observing or implementing obligations under the Common Agricultural Policy,
    • the prohibition and regulation of movement into and out of Wales of animal feeding stuffs, fertilisers or pesticides (or things treated by virtue of an enactment as pesticides) for the purposes of protecting human, animal or plant health or the environment.

(But prohibition and regulation for the purposes of protecting endangered species of plants and animals is not excepted, and so is reserved.)
