Part II of the Environmental Protection Act 1990 contains a prohibition on the unauthorised deposit of waste on land, a duty of care in relation to the transfer of waste, and various powers and duties of local authorities in relation to the collection and disposal of municipal and commercial waste. Part II also defines, for purposes of the Act, household, commercial and industrial waste, and contains provisions to permit a local authority to charge for collection of certain categories of waste.

The Controlled Waste (England and Wales) Regulations 2012 classify waste materials by type and origin, in relation to local authority powers to charge for collection of waste.
