Regulating other persons who provide social care services
The Regulation and Inspection of Social Care (Wales) Act 2016 (the "2016 Act”) reformed the regulatory regime for care and support services in Wales, and also reformed the system of regulation of those who work in the sector and provide care for vulnerable adults or children.
The Welsh Ministers have regulatory functions under the 2016 Act, but these are carried out by Care Inspectorate Wales on a day to day basis.
A number of services which provide social care are regulated under the 2016 Act. Any person who wants to provide a regulated service is required to register with Care Inspectorate Wales. A provider must designate a person to fulfil the role of “responsible individual” to oversee the management of the service and undertake key responsibilities. There are separate regulations made under the 2016 Act in relation to each type of regulated service which set out in greater detail the regulatory requirements which apply.
The following services are regulated under 2016 Act:
- a care home service
- a secure accommodation service
- a residential family centre service
- a domiciliary support service
- a fostering service
- an adoption service
- an adult placement service
- an advocacy service
